Purchase Agreement for the Online Store
This distance purchase agreement is made between SIA TOP NAILS LATVIA, registration No. 50203378621, legal address: Slokas iela 187-26, Riga, LV-1067 (hereinafter – Seller), and a natural or legal person (hereinafter – Buyer), who places an order and purchases goods on the online trading site www.topnailslatvia.lv (hereinafter – Site).
1.1. The Buyer orders, purchases, and pays for the goods, while the Seller delivers and sells the goods listed on the Site and selected by the Buyer in accordance with the provisions of this distance agreement (hereinafter – Agreement).
1.2. The Agreement is binding for all orders and purchases made on the Site.
2.1. The Buyer selects the goods, reviewing their description, characteristics, key features, and price, as well as assessing their suitability and compliance with their needs.
2.2. By confirming the order of the goods, the Buyer fills out the order form, indicating:
2.3. The Buyer is responsible for accurately filling out the order form and providing correct data. The Seller is not liable for any losses incurred by the Buyer or a third party due to the Buyer providing an incorrect delivery address or incomplete information.
2.4. Upon receiving the Buyer’s order, the Seller sends the Buyer an order confirmation via email. If the Buyer does not receive a confirmation email from the Seller, the Buyer’s order is not accepted, and this Agreement does not come into effect.
2.5. By confirming this agreement and purchasing products whose use and purchase restrictions are defined by the laws of the Republic of Latvia, the Buyer certifies that they are at least 18 years old.
3.1. The Agreement comes into effect at the moment the Buyer places an order for the goods on the Site.
4.1. The price of the goods on the Site is indicated in EUR. The goods are sold to the Buyer at the price in effect on the Site at the time of placing the order.
4.2. The price of the goods does not include delivery costs. Delivery costs are applied separately according to the delivery method chosen by the Buyer. Delivery costs are indicated on the Site to the Buyer before order confirmation and are included in the invoice issued by the Seller. Delivery costs include the value-added tax at the rate specified in the laws of the Republic of Latvia.
5.1. The Buyer is obliged to pay for the goods and the chosen delivery method in accordance with the provisions of the Agreement and within the specified timeframe.
5.2. The Buyer makes payment for the ordered goods and the delivery method according to the payment method chosen by the Buyer on the Site.
5.3. Payment for the goods and the chosen delivery method is considered made when the Seller has received the payment amount for the goods and the chosen delivery method in full.
5.4. If the Seller is obliged to refund the Buyer the amount paid for the goods and delivery according to the provisions of this Agreement, the Seller will refund the specified amount to the Buyer using the same payment method that the Buyer used to purchase the goods, unless the Buyer explicitly agrees to another payment method and does not incur additional costs for using that payment method.
6.1.–6.5. Full conditions of delivery, Buyer obligations, damage protocol, and risk transfer.
7.1.–7.3. Buyer’s inspection duties upon receipt, rights to replacement or refund, and how to contact the Seller for claims.
8.1.–8.3. Buyer must use goods as intended and in accordance with instructions.
9.1. Buyer may unilaterally withdraw from the Agreement under Latvian law without providing justification.
10.1. By registering and/or ordering goods, Buyer consents to personal data processing as per Privacy Policy.
11.1.–11.3. Seller is not liable for issues caused by Buyer or force majeure; only direct damages are compensated.
